Rape and Statutory Rape: Penalties
The crimes of rape and statutory rape can be classified as either criminal sexual conduct in the first degree or third degree. The crime becomes first degree if aggravated circumstances are involved: rape with injury, use of a weapon, victim under the age of 13, and more.
- 1st degree criminal sexual conduct — Life in prison
- 3rd degree criminal sexual conduct — 15+ year mandatory prison sentence
The difference between first and third degree criminal sexual conduct can be contingent on the presence of injury. However, under Michigan law, "injury" can refer to something as minor as bruising.
