Rape/Statutory Rape

Detroit, Michigan Rape and Statutory Rape Defense

Have You Been Charged with Rape? We Can Help.

Under Michigan law, individuals under the age of 16 are considered legally unable to give consent for sex. When one individual 16 or older makes sexual contact with an individual under the age of 16, he or she is committing a crime.

At Ribitwer & Sabbota, L.L.P. we defend individuals throughout the Detroit area charged with rape and statutory rape. To discuss the charges being held against you in a free consultation with a criminal defense attorney, contact us online or call (866) 560-7029.

Rape and Statutory Rape: Penalties

The crimes of rape and statutory rape can be classified as either criminal sexual conduct in the first degree or third degree. The crime becomes first degree if aggravated circumstances are involved: rape with injury, use of a weapon, victim under the age of 13, and more.

  • 1st degree criminal sexual conduct — Life in prison
  • 3rd degree criminal sexual conduct — 15+ year mandatory prison sentence

The difference between first and third degree criminal sexual conduct can be contingent on the presence of injury. However, under Michigan law, "injury" can refer to something as minor as bruising.

Are You Facing Rape Charges?

  • Rape — Using force or coercion to have sexual intercourse with an individual against his or her will.
  • Statutory rape — Any type of sexual penetration by one individual age 16 or older to another between the ages of 13 and 16. Under Michigan law, minors between the ages of 13 and 16 are legally unable to give consent for sex, which is why this conduct is considered rape. (Sexual contact involving a child under the age of 13 is considered criminal sexual conduct in the first degree — child molestation.)

If you have been accused of rape, statutory rape, or date rape, you are facing potentially life-changing penalties. You also face a critical decision: choosing the right defense attorney to protect your rights.

The lawyers of Ribitwer & Sabbota have years of experience as prosecutors in addition to decades of experience in criminal defense. We know the law and know how to effectively protect your rights and seek optimal results if you have been charged with rape.
